SMC³ Privacy Policy

SMC³ is committed to protecting your privacy. As a result, we have instituted this Privacy Policy. SMC³ is providing this notice to explain how we collect, use, disclose, and protect the personal information we maintain about you. This Privacy Policy applies to data collected through the SMC³ website (“the Site”) as well as data collected through SMC³ products and solutions, events and trainings, and otherwise both online and offline. This policy does not apply to the practices of companies that SMC³ does not own or control or to individuals whom SMC³ does not employ or manage, including operators of sites you may link to from the Site or from which you link to the Site.

In general, you may visit the Site and view its contents while remaining anonymous by not providing any personal information, with the exception of tracking technologies which may collect information about you as described below. By using the Site or otherwise engaging with us, you agree to the terms of this Privacy Policy, and if you provide your personal information, you consent to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree with this policy, please do not provide any information.

As used in this Privacy Policy, “we” includes SMC³ and its affiliates. Affiliates are required to maintain the confidentiality of the user information and prohibited from using it for any purpose other than as described in this Privacy Policy.

Information We Collect

In order to use the Site (such as downloading white papers, registering for educational seminars and conferences, requesting online product demonstrations, making online product purchases, etc.) or use our products and services, you may need to provide us with certain information about you such as your name, mailing address, telephone number, email address, job title, company information and certain other personal and demographic information you may provide. If you create a customer login, we will also collect your login and password.

If you make a purchase, we may also ask for your credit card information to process your order. This information will not be used for any purpose other than processing and/or referencing your order, is not stored in any SMC³ database, and will not be shared with anyone. All payment processing is handled by a third party payment service provider.

While accessing and operating an online SMC³ product, the SMC³ software will record general statistical and tracking information, such as the date and time a client accesses his/her product and the time spent using it. The SMC³ software transfers this information to SMC³’s servers, and such information is used for internal resource management purposes.

We also may collect non-identifiable information that becomes available to us as a result of your visit to the Site or login to an application. This information includes, for example, your IP address (which is sometimes considered personal information and is a number automatically assigned to your computer when you visit the Site or login), your Internet Service Provider (“ISP”), your web browser, the type of operating system, the domain name of the website which links you to our Site, the pages you visited, and the length of each visit to the Site.

Because we are very interested in the successful dissemination of information, we will review trends recorded on certain log files. In connection with such log files, analysis software will be used to generate reports which will allow us to determine how we can enhance your experience with our Site and applications. This information will not be used to ascertain your identity, and the log files may be purged periodically, at our discretion, to maximize space on the server.

Finally, we collect personal information from job applicants who seek employment with SMC³. We collect their personal information through the career’s portal of our Site and otherwise throughout the hiring process. Personal information collected from job applicants may include contact information as well as information about their education and past employment.

Collection of Personal Information from or about Children

Persons under the age of eighteen (18) are not permitted to register with SMC³ and SMC³ does not knowingly collect, either online or offline, personal information from or about persons under the age of eighteen (18). If we learn that a child under the age of eighteen (18) has provided us with personal information, we will attempt to delete this information from our databases, subject to any technical limitations on our ability to do so.

Use of Personal Information

Your personal information is generally used for the following purposes:

• to make the SMC³ Site easier to use by not making you enter your personal information more than one time;

• to help you quickly find SMC³ software, services, or other information;

• to create and manage your account;

• to help us create and promptly deliver content most relevant to you;

• to alert you to product upgrades, updated information and the availability of new functionality;

• to send you promotional and advertising materials we believe may be of interest;

• to provide our products and services and facilitate your use of them;

• to respond to inquiries and solicit feedback and survey responses;

• to administer, personalize, and improve our Site and services;

• to develop new features and services;

• to generate statistics and de-identified data;

• to prevent, detect or fight fraud or illegal activities;

• to evaluate job applicants for employment;

• to comply with legal requirements; and

• for any other purpose with your consent.

Disclosure of Personal Information

SMC³ does not sell, rent, distribute or provide your personal information to third parties. We may aggregate personal information about our users to determine the general demographic makeup of our users, types of transactions, etc., but aggregated information will not identify specific individual information. We occasionally hire other companies to provide limited services on our behalf, such as handling the processing and delivery of mailings, providing surveys, or performing statistical analysis of our services. We only provide to those companies the personal information they need to deliver the service. They are required to maintain the confidentiality of your personal information and are strictly prohibited from using your personal information for any other purposes. In addition to disclosures to service providers, we may also disclose your personal information to our business partners with whom we may collaborate to provide an integrated solution, for example.

In addition, we may share your personal information with any third party, without your consent or approval and without notice to you, (i) as permitted or required by law, (ii) to protect and defend the rights of SMC³, its employees, and its affiliates; (iii) as incident to a corporate sale, merger, reorganization, dissolution, bankruptcy or similar event, (iv) under circumstances we believe reasonably necessary to protect the personal safety of our employees, users of SMC³ solutions, its Site, or the public, (v) to disclose information that is necessary to identify, contact or bring legal action against someone who may be violating our published policies, or (vi) with any other third party with your consent.

Cookies & Other Tracking Technologies

We from time to time use cookies and similar tracking technologies on the Site. Cookies are small text files that your web browser leaves on your hard drive. Cookies collect user activity information including IP address (which is often considered personal information), geolocation data, browser and device characteristics, operating system, language preferences, referring URLs, information about how and when you use the Site, and other technical details. The various types of cookies we use may be described as follows:

• Necessary cookies. These are cookies that are required for the operation of the Site.

• Functionality cookies. These cookies remember choices you make and are used to recognize you when you return to the Site.

• Analytics cookies. These cookies collect information about how you use the Site. They allow us to recognize and count the number of visitors and to see how visitors move around within the Site.

• Advertising cookies. These cookies are used to track your online activity and deliver personalized advertisements. Our Site does not currently use these types of cookies.

We may use third party analytics service providers such as Google Analytics to help us analyze traffic on our Site. You can prevent Google Analytics from recognizing you on return visits to this Site by following the Google opt-out process.

Some internet browsers have “Do Not Track” or “DNT” features which, when turned on, send a signal to the website that the individual visiting the website does not wish to be tracked. Our Site does not honor DNT signals, but you can adjust your browser’s cookies settings to reject cookies as discussed above.

Third Party Links

The Site may contain links to other websites. Please recognize that we do not control these third party websites and this Privacy Policy will not apply to those websites. You should consult each applicable privacy policy before using another linked website.

Data Security

We have security measures in place designed to protect against the loss, misuse, and alteration of the information under our control. While we strive to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third parties from intercepting your personal information. You should not assume or expect that any communication that you transmit to us (such as personally identifiable or other data, questions or answers, comments, or suggestions) is confidential. SMC³ and its internet service providers shall not be liable or responsible if any information about you is intercepted and used by an unintended recipient.

Data Retention

SMC³ may store personal information for as long as we have a legitimate business need for it. We determine the retention period for each category of personal information based on (i) the length of time we need to retain the information to achieve the business or commercial purpose for which it was obtained, (ii) any legal or regulatory requirements applicable to such information, (iii) internal operational needs, and (iv) any need for the information based on any actual or anticipated investigation or litigation.

International Users

SMC³ is located in the United States and processes and stores data there. Personal information we collect about you may be processed in the United States. By submitting your personal information to us, you consent to the transfer, storage, and processing of your personal information in a country other than your country of residence.

Your Privacy Choices

Marketing Communications. You may opt-out of receiving promotional or marketing emails from SMC³ at any time by using the “unsubscribe” link in the email you receive or by submitting a request through the contact form on the Site. You may also opt-out of receiving print mail by submitting a request through the contact form on the Site. Please note that we reserve the right to continue to send you other non-marketing communications, including service announcements, administrative messages, and surveys related to your account.

Access and Correction. You may contact us at the contact information below if you think any information we have about you is inaccurate or incomplete, or if you want to access or make changes to the information we have about you.

California Residents: Your Rights

This section supplements the remainder of this Privacy Policy with additional disclosures and information about the privacy rights of California residents pursuant to the California Consumer Privacy Act, as amended by the California Privacy Rights Act (the “CCPA”).
